The children of retired Manteca police Lt. Jerry Kubena believe their dad didn't have to die when he was rushed to St. Joseph's Medical Center for a heart attack last June.They blame the emergency room doctor, Cleveland Enmon, for causing their father's death.
"He abandoned is efforts to resuscitate Mr. Kubena, and surreptitiously removed the watch and put it in his pocket," said Jeffrey Silvia, attorney for the family.
And there were witnesses. According to the suit, two nurses noticed that the watch went missing from Lt. Kubena, and saw a bulge in the doctor's pocket. They notified security who told everyone to stay put.
But the suit alleges doctor Enmon instead slipped outside. Surveillance cameras captured him walking into the parking lot. One of the nurses followed him and allegedly saw him throw something from his pocket to the parking area.
"She walked security to this area, and they walked over to this grassy area, bent down and picked up Mr. Kubena's watch," Silvia said.
Hospital administrators reportedly fired Enmon on the spot.
A hospital spokeswoman reached tonight, said they had no comment.
"He was released from St. Joseph's,"Silvia said. "My information is he was told he could not work at St. Joseph's anymore."
The family believes their father could still be with them, if the doctor only did his job.
"Their greatest fear is that this man, allowed their father to die," Silvia added.
